What Montana Buyers, Sellers, and REALTORS® Need to Know

As of March 1, 2026, the new federal residential real estate reporting requirement is officially in effect nationwide, including here in Montana.

The rule comes from the Financial Crimes Enforcement Network (FinCEN), a bureau of the U.S. Department of the Treasury. Its goal is straightforward: increase transparency in residential real estate transactions that could be used for money laundering or illicit financial activity.

Here’s what that means for Montana real estate professionals and their clients.

What Is the New FinCEN Rule?

The FinCEN Residential Real Estate Reporting Rule requires a “Real Estate Report” to be filed for certain non-financed residential transactions involving legal entities or trusts.

It targets transactions that meet all three of the following conditions:

  1. The property is residential real estate (1–4 unit homes, condos, townhomes, co-ops, or vacant land intended for 1–4 family construction).
  2. The transaction is non-financed (no bank or regulated mortgage lender involved).
  3. The buyer is a legal entity or trust, not an individual.

If all three are present, reporting will likely be required.

Who Files the Report in Montana?

In most Montana transactions, the reporting responsibility will fall on the settlement agent, title company, or closing attorney.

Montana does not use attorneys for every closing, so in many cases your title partner will be the reporting party. That said, REALTORS® should anticipate client questions and coordinate early with closing professionals to avoid delays.

Pro tip: If you see “LLC,” “Corp,” or “Trust” on the buyer line, start the conversation early.

What Information Will Be Collected?

The Real Estate Report requires disclosure of:

  • The legal entity or trust purchasing the property
  • Beneficial owners behind that entity
  • Individuals signing on behalf of the buyer
  • Seller information
  • Method of payment and transaction details

This reporting is submitted directly to FinCEN and is not filed with the county clerk and recorder.

Why This Matters in Montana

Montana has seen increased use of:

  • LLCs for investment properties
  • Trust structures for estate planning
  • Cash or alternative financing in rural and second-home markets

In areas like Flathead County and other high-demand markets, entity purchases are not uncommon. That means this rule will affect real transactions in our region.

Early education will be key.

What Montana REALTORS® Should Do Now

  • Update buyer intake questions to clarify ownership structure
    • Communicate with title companies about reporting workflows
    • Prepare entity buyers for additional documentation requests
    • Watch for guidance updates from the National Association of Realtors and the Montana Association of Realtors

This is a compliance shift, not a transaction killer. The goal is transparency — not disruption — but preparation will prevent last-minute closing stress.

Most traditional Montana buyers using mortgage financing through regulated lenders will not be impacted. However, cash purchases and transactions involving LLCs or trusts now require federal reporting.
